    建請勞動部讓留臺覓職僑外生的工作許可證效期延長6個月。It is recommended that the Ministry of Labor extends the validity period of work permits by 6 months for overseas Chinese and foreign students staying in Taiwan to find employment.
     
    1. 依就業服務法第43條規定,外國人未經雇主申請許可,不得在臺從事工作。爰僑外生畢業後已非就業服務法第50條規定之學生身分,於居留效期屆滿前,得以覓職理由,申請延期居留,係利其求職,促使僑外生畢業後能留臺服務,故依現行法令規定,畢業僑外生覓職期間未經聘僱許可,不得從事工作。
    1. In accordance with Article 43 of the Employment Service Act, “no foreign worker may engage in work within the Republic of China should his/her employer have not yet obtained a permit via application therefore.” After graduating, overseas Chinese and foreign students who do not have student status under Article 50 of the Employment Service Act may apply to extend their residence for the purpose of seeking employment before the validity period of their residence expires. This facilitates their job search and encourages overseas and foreign students to remain and work in Taiwan after graduation. Therefore, in accordance with current laws and regulations, graduating overseas Chinese and foreign students are not allowed to engage in work during their job search period without a work permit. 
     
    2. 僑外生如欲在臺從事專門性或技術性工作,可循一般資格申請聘僱許可,或循僑外生工作評點配額制,以學歷等8個項目進行評點,由欲聘僱畢業僑外生之雇主先行試評,各項評點累計滿70點,由雇主提出申請聘僱該名僑外生之工作許可。
    2. If overseas Chinese and foreign students wish to engage in specialized or technical works in Taiwan, they can apply for a work permit based on Wages and Work Experience or apply according to the New Scoring Criteria for Foreign and Overseas Chinese Students to Work in Taiwan. The system scores students according to 8 comment items such as academic qualifications. Employers wishing to hire overseas Chinese and foreign students who have graduated will first conduct a trial evaluation. If the accumulative point for each item reaches 70 points, the employers can apply for a work permit to hire the overseas Chinese or foreign student.

    應屆畢業僑生工作許可證效期只到 6 月 30日,勞動部能否參考移民署僑生持畢業證書可延長居留證效期 6 個月的作法,使工作許可效期增加半年,俾讓畢業留臺半年的僑生能合法打工,以負擔覓職期間的生活費。
    一、依就業服務法第 43 條規定,外國人未經雇主申請許可,不得在臺從事工作。爰僑外學生畢業後已非就業服務法第 50 條規定之學生身分,於居留效期屆滿前,得以覓職理由,申請延期居留,係利其求職,故覓職期間未經勞動部許可,不得從事工作。
     
    二、僑外學生如欲在臺從事專門性或技術性工作,可循一般資格申請聘僱許可,或循畢業僑外生工作評點配額制,以學歷等 8 個項目進行評點,由欲聘僱畢業僑外學生之雇主先行試評,倘經各項評點累計滿 70 點,由雇主提出申請聘僱該名僑外學生之工作許可。

    畢業後在台半年的覓職期間,沒找到工作前,無法申請工作證在台合法打工賺取生活費?During the 6-month job-seeking period after they graduate, are students allowed to take do temporary work to cover their living expenses before they become formally employed?
    1.依就業服務法第43條規定,外國人未經雇主申請許可,不得在臺從事工作。爰僑外生畢業後已非就業服務法第50條規定之學生身分,於居留效期屆滿前,得以覓職理由,申請延期居留,係利其求職,促使僑外生畢業後能留臺服務,故依現行法令規定,僑外生覓職期間未經聘僱許可,不得從事工作。
    Article 43 of the Employment Service Act stipulates that if an employer has not applied for a work permit for a foreigner, that foreigner is not permitted to engage in work in Taiwan. As soon as a foreign student or overseas Chinese student graduates, they no longer have the status of any student referred to  in Article 50 of the Employment Service Act, and before their residency expires, they are allowed to apply for to expend their residency for the\ purpose of seeking employment, to encourage them to remain in Taiwan after their graduation and contribute their services. The current legislation does not permit any foreign student or overseas Chinese student to engage in any work while they are looking for a job after they graduate.
     
    2.僑外生如欲在臺從事專門性或技術性工作,可循一般資格申請聘僱許可,或循僑外生工作評點配額制,以學歷等8個項目進行評點,由欲聘僱畢業僑外生之雇主先行試評,倘經各項評點累計滿70點,由雇主提出申請聘僱該名僑外生之工作許可。
    A foreign student or overseas Chinese student who wants to engage in specialized or technical work in Taiwan after graduating may apply for a work permit using the standard salary and work experience criteria, or using the point system for assessment of foreign students and overseas Chinese students for employment. The point system gives candidates points for eight items, including level of education. The prospective employer makes the initial assessment and if the candidate has a total point score of 70 points or higher, submits an application for a work permit to employ the candidate.

    覓職期可以開放工讀嗎? Can students work part-time during job search period?
    依就業服務法第43條規定,外國人未經雇主申請許可,不得在臺從事工作。爰僑外生畢業後已非就業服務法第50條規定之學生身分,於居留效期屆滿前,得以覓職理由,申請延期居留,係利其求職,故覓職期間未經勞動部許可,不得從事工作。
    According to Article 43 of the Employment Services Act, foreigners are not allowed to work in Taiwan without an employer's application for permission. As stipulated in Article 50 of the Employment Service Act, after graduation, foreign students are no longer of student status and can apply for residence extension with the intention of job search, before the expiry date of their residence, but are not allowed to work without permission from the Ministry of Labor.

    評點制 New Scoring Criteria (10)

    評點制的配額是否每年都會調整?若然,調整的依據是什麼?
    勞動部依據「強化優秀僑外生留臺工作行動計畫」(下稱行動計畫),自103年7月起推動僑外生留臺工作評點制。依該行動計畫,係由勞動部會同教育部及國家發展委員會等部會,參考實施情形、各屆畢業人數、雇主需求人數、國內就業市場及經濟情勢,滾動檢討,調整各年度配額人數。

    關於僑外畢業生留臺工作評點制的他國語言能力說明中的「FLPT」合格標準為幾分?

    評點制的薪資是單指薪資項目,或包括各種津貼的總和。Does the “salary” in the Scoring Criteria System refer only to wages alone or it is a lump sum that includes all other kinds of allowances?
    依勞動基準法第 2 條第 2 款規定,工資係勞工因工作而獲得之報酬;包括工資、薪金及按時、計日、計月、計件以現金或實物等方式給付之獎金、津貼及其他任何名義之經常性給與均屬之。
    According to Article 2, Subparagraph 3 of the Labor Standards Act, wage means the remuneration that a worker receives for his or her services rendered, and includes wages, salaries and bonuses, allowances and any other regular payments regardless of the name under which it may be computed on an hourly, daily, monthly and piecework basis, whether payable in cash or in kind.

    關於工作評點制的評分制度,外國語文憑有年限或分數門檻限制嗎? Regarding the New Scoring Criteria is there a limit on when a foreign language diploma was received, or a score threshold?
    依勞動部110年12月10日勞動發管字第11005194311號公告僑外生評點制申請及應備文件,評點項目「他國語言能力」係採認僑外生護照影本,如需認定二項以上他國語言能力,僅需檢附語言能力證明文件影本或修習達360小時證明,爰依前開公告,如檢附語言能力證明並未設限合格成績,該文件應為有效。
    According to the Ministry of Labor's Dec. 10, 2021 Announcement No. 11005194311, the application and required documents for the New Scoring Criteria for overseas Chinese and foreign students for the evaluation item of "Foreign language proficiency" is a photocopy of the passport of the student. For recognition of foreign language proficiency in two or more language other than Chinese, it is required to attach a copy of the language proficiency certificate or a certificate of 360 hours of training. According to the announcement, a language proficiency certificate does not need to meet the score threshold, the document should be valid.

    有關申請工作評點制擔任職務資格的問題,因修課名稱與學習內容不同,但學習內容與工作內容有關,請問要如何證明有擔任職務的資格? Regarding job qualifications required by the New Scoring Criteria, because the title of the course and the learned content is different, but the learned content is related to the job responsibility, how can I prove that I have the qualifications to hold the position?
    依勞動部110年12月10日勞動發管字第11005194311號公告僑外生評點制申請及應備文件,評點項目「擔任職務資格」係採認僑外生具職務特殊專長能力之證明文件影本。(如擔任該職務所需之專業訓練、修習課程、技能檢定、創作著作比賽得獎專利等證明)。前開修習課程相關證明包含載有與欲擔任職務相關之課程成績單或論文,倘課程名稱無法判斷,得檢附相關授課大綱。
    According to the Ministry of Labor's December 10, 2021 Announcement No. 11005194311, application and documents for the New Scoring Criteria for overseas Chinese and foreign students, the evaluation item for "qualification for holding positions" is a photocopy of the certification document that recognizes overseas Chinese and foreign students with special expertise and capacity for the job. (For example, proof of professional training, training courses, skill tests, proof in creative writing competitions, etc.). Relevant certificates of previous courses should contain the transcript or thesis of the course related to the position to be held. If the title of the course does not seem relevant to a position, a syllabus may be attached.

    兼職及實習的工作經驗是否算在評點制的工作經驗內? Does part-time and internship work consider as “work experience” under the New Scoring Criteria?

    According to the Ministry of Labor's Dec. 10, 2021 Announcement No. 11005194311, for the application and required documents for the New Scoring Criteria for overseas Chinese and foreign students, the evaluation item of "work experience" refers to the proof of work experience after obtaining a bachelor's degree.

    具有華語以外的2種外語能力可以獲得20點,如果再考取超過一種外語證明 可以再累積成40、60點嗎? I can obtain 20 points if I have 2 foreign language skills other than Chinese. If I get an additional foreign language certificate, will I then accumulate 40 or 60 points?

    Under the Ministry of Labor's December 10, 2021 Announcement No. 11005194311, the application and required documents for the New Scoring Criteria for overseas Chinese and foreign students, the evaluation item of ”Foreign Language Proficiency”, with the proficiency in two or more languages other than Chinese, the score is 20 points.     請問財務會計是否屬於行政部門? Is financial accounting part of the administrative department?
    按外國人從事就業服務法第46條第1項第1款至第6款工作資格及審查標準(下稱審查標準)第21條規定略以,外國人受聘僱於證券、期貨事業、金融事業或保險事業等從事財稅金融服務工作,其工作內容應為相關金融保險業務、協助處理商業會計事務或會計師法所定業務。次按審查標準第34條及第35條規定略以,外國人受聘僱於製造業或批發業工作,其工作內容應為經營管理、設計、規劃、技術指導等。故僑外生欲留臺擔任之職務名稱如為財務會計,須依前開規定審認其工作內容是否符合外國人得從事之專門性或技術性工作。
    Under Article 46, Item 1, paragraphs 1 to 6 of the Employment Service Act for Foreigners, the qualifications for work and the review standards (hereinafter referred to as the Review Standards) Article 21 are as follows, foreigners employed in securities, futures,  financial, insurance, or engaged in any taxation and financial services, the content of their work should be related to financial and insurance business, assisting in the handling of commercial accounting affairs or the business prescribed by the Certified Public Accountant Act. Under Articles 34 and 35 of the Review Standard, for foreigners who are employed in manufacturing or wholesale industries, their job responsibility should be business management, design, planning, technical support, etc. Therefore, if the job title is financial accountant, the person must verify whether the job content conforms to the specialized or technical work that foreigners are allowed to engage in, under the previous regulations.

    行政人員的定義是什麽? 是政府還是公司的行政人員? 專案人員算行政人員嗎? What is the definition of an administrator? Is it a government or corporate administration? Are project-based employee considered administrative staff?
    行政人員係依照企業或組織內部行政流程,處理一般行政庶務工作。至專案人員是否為行政人員,須視其工作內容而定。
    Administrative personnel handle general administrative affairs following the internal administrative procedures of a company or organization. Whether a project-based staff is considered administrative staff depends on the content of their work.

    評點制中有一項外國語言的點數,1項是10點,2項是20點,如果馬來西亞僑外生從小學即學習中、英、馬三語,提供護照影本的話算10點還是20點? One of the evaluation items in the New Scoring Criteria system is “foreign language proficiency”. It lists 1 item earns 10 points, and 2 items are 20 points. If a Malaysian foreign student learned Chinese, English, and Malay since primary school, does it count 10 or 20 points, with provision of a copy of the passport?

    Under the Ministry of Labor's December 10, 2021 No. 11005194311 announcement, the application and required documents for the New Scoring Criteria system for overseas Chinese and foreign students, the evaluation item "Foreign Language Proficiency," a photocopy of the passport provides proof of the official language of the country. Therefore, if the foreigner is Malaysian, the Malay language is the official language accordingly.     相關規定 Regulations (6)

    雇主需要符合什麼條件才能合法僱用畢業後留臺之僑外生。What are the requirements for employers to legally hire overseas Chinese and foreign students who are staying in Taiwan after they have graduated?
    1.依外國人從事就業服務法第46條第1項第1款至第6款工作資格及審查標準(下稱審查標準)規定略以,雇主欲申請聘僱外國人(含畢業僑外生)從事專門性或技術性工作、僑外資事業主管、學校教師、補習班語文教師、運動教練及運動員、藝術及演藝工作等6類工作,其雇主須具備目的事業主管機關核發許可證明、執業執照或核准立案等資格條件。
    1. In accordance with Qualifications and Criteria Standards for foreigners undertaking the jobs specified under Article 46.1.1 to 46.1.6 of the Employment Service Act (hereinafter referred to as the review standards), employers wishing to employ foreigners (including graduated overseas Chinese students) for the six categories of work, namely professional or technical work, overseas Chinese and foreign business supervisory work, school teachers, cram school language teachers, sports coaches and athletes, and art and performing arts work are generally required to have eligibility such as a permit, practice license or approved registration issued by the competent authority for the target business.
     
    2.審查標準就上開雇主聘僱外國人從事專門性或技術性工作之資格條件,規定不動產經紀業者、移民服務業者、環境保護業者、文化運動及休閒服務業者、製造業者、批發業者,應符合資本額及營業額達一定金額以上(本、外國公司設立未滿1年者,其實收資本額應達5百萬元以上,或營業額達1千萬元以上;設立1年以上者,最近1年或前3年度平均營業額達1千萬元以上)。又雇主循一般資格申請聘僱外國人從事專門性或技術性工作,其職務薪資須達每月新臺幣(下同)4萬7,971元以上。
    2. The review standards for the eligibility of the abovementioned employers who wish to employ foreigners for specialized or technical work stipulate that real estate brokers, immigration service providers, environmental protection companies, cultural sports and leisure service companies, manufacturers, and wholesalers must have a capital and turnover above a certain amount to qualify (for domestic and foreign companies that have been established for less than a year, the actual paid-in capital should be more than NT$5 million or the turnover should be more than NT$10 million; for those that have been established for more than one year, the average turnover in the last year or over the last three years should be more than NT$10 million). In addition, employers applying to employ foreigners for specialized or technical jobs based on general qualifications must provide a salary of NT$47,971 per month or above (similarly hereinafter) for the position. 
     
    3.另勞動部配合「創業拔萃方案」,免除具創新能力之新創事業雇主上述資本額與營業額限制,及外籍專門技術人才學經歷限制;放寬創新新創僑外資事業聘僱外籍主管之資本額及營業額限制及放寬外籍主管不以經理人為限(即可擔任部門副主管以上職位,第2名以上外籍主管僅需符合受聘月薪4萬7,971元)。
    3. Moreover, in coordination with the “HeadStart Taiwan”, the Ministry of Labor is exempting the abovementioned capital and turnover requirements for employers with innovative capabilities. Foreigners with specialized technical expertise are also exempt from the academic and job experience requirements. The capital and turnover requirements for hiring foreign supervisors are also relaxed for innovative and startup foreign investment companies, and the supervisory position of the foreigners is not limited to manager (that is, they can hold positions as the deputy director of departments or above. The only requirement for the second foreign supervisor and thereafter is a monthly salary of NT$47,971).
     
    4.承上,雇主可持相關資格證明文件及僑外生資格文件,向勞動部申請聘僱許可(學校教師須向教育部申請),經審查符合規定資格並許可後,僑外生即可在臺工作。
    4. In continuation of the above, employers can apply for work permits to the Ministry of Labor (for school teachers, apply to the Ministry of Education) by providing relevant eligibility documents and qualification documents of the overseas Chinese or foreign students. Upon review and approval of the qualifications and issuance of permit, the overseas Chinese and foreign students may work in Taiwan.

    僑外生畢業後留臺工作申請作業是否有SOP或流程表。Is there any SOP or flow chart for overseas Chinese student and foreign student applying to stay and work in Taiwan after graduation?
    1.為協助畢業僑外生留臺工作,勞動部於「外國人在臺工作服務網 」(https://ezworktaiwan.wda.gov. 」建置畢業僑外生留臺工作專區,提供相關法令規定、申請書表及應備文件之說明。
     
    To assist graduate overseas Chinese student and foreign student to stay and work in Taiwan, the Ministry of Labor have established foreigner staying and working in Taiwan corner on the EZ Work Taiwan Website (https://ezworktaiwan.wda.gov.tw/ ) to provide information on relevant regulation, application form and required documents.
     
    2.上開網站於審查作業手冊項下並公告有「外國專門性及技術性工作人員 在臺畢業僑外生評點制 申請聘僱許可審查作業手冊 」,彙整申請規定及審查原則,供雇主及外國人參閱。
     
    On the website, under the SOP manual, there is an announcement of “Overseas Chinese or Foreign Student Graduate in the R.O.C. to work in Taiwan (SOP Manual)” which summarized application regulations and reviewing procedure for the references of employers and foreigners.

    外國學生畢業後留臺工作是否有行業別限制。Are there any industry-specific restrictions on foreign students staying to work in Taiwan after graduation?
    依就業服務法第 43 條規定,除本法另有規定外,外國人未經雇主申請許可,不得在中華民國境內工作;復依本法第 48 條第 1 項規定,雇主聘僱外國人工作,應向勞動部申請許可。爰畢業僑外生欲在臺工作,應符合「外國人從事就業服務法第 46 條第 1 項第 1 款至第 6 款工作資格及審查標準」規定,經雇主申請從事 一、專門性或技術性工作、 二、僑外資事業主管、三、學校教師、四、補習班語文教師、五、運動教練及運動員、六、藝術及演藝工作等 6 類工作。
     
    According to Article 43 of the Employment Service Act, unless otherwise specified in the Act, no foreign worker may engage in work within the Republic of China should his/her employer have not yet obtained a permit via application therefore; Further, according to Paragraph 1, Article 48 of this Act, prior to employing foreign workers to engage in work, employers shall apply to the Ministry of Labor for the work permit. Therefore, overseas Chinese student and foreign student, who graduate and intend to work in Taiwan, shall meet the requirements of the “Qualifications and Criteria Standards for Foreigners Undertaking the Jobs Specified under Subparagraphs 1-6, Paragraph 1, Article 46 of the Employment Service Act”, and apply via employees for engaging in the following six (6) categories of work: (1) specialized or technical work (2) director/manager/executive of a business invested in or set up by overseas Chinese or foreigner (s) with authorization (3) teachers at the designated schools (4) language teachers for supplementary schools (5) sports coach and athlete (6) artistic work and performing arts.

    是否可以讓有意在臺發展及工作的僑外生有更容易留臺的機會。Is it possible to make it easier for overseas Chinese and foreign students who wish to remain in Taiwan to pursue development and work in Taiwan?
    為留用在臺大學畢業之優秀僑外生,勞動部實施「僑外生工作評點配額制」,免除聘僱薪資、工作經驗等條件限制,以8個項目評點(總點數190點),累計取得70點且雇主符合聘僱資格並經核准,僑外生即可受聘僱在臺從事專門性或技術性工作。現行僑外生以學歷、具職務專長能力、修習一定時數之中文課程,及以其護照採認他國語言及他國成長經驗等項目,即可取得70點,且所附國外相關證明文件免驗證程序,相關規範及應備文件係從寬審認,利於優秀僑外生在臺發展。
    To retain outstanding overseas Chinese and foreign students graduating from universities in Taiwan, the Ministry of Labor has implemented the New Scoring Criteria for Foreign and Overseas Chinese Students to Work in Taiwan to exempt students from the salary and work experience requirements. The criteria are based on 8 assessment items (total score is 190 points). If a student has an accumulative 70 points and the employer is eligible to hire and has been approved, the overseas Chinese or foreign student can be employed in Taiwan for specialized or technical work. Overseas Chinese and foreign students who currently have items such as academic qualifications, professional expertise, a certain number of hours of Chinese courses, other foreign language qualification as determined according to their passports and foreign development experience can earn 70 points. They may submit relevant foreign documents for exemption from the verification procedure. The review of the relevant standards and required documents are lenient to facilitate the development of outstanding overseas Chinese and foreign students in Taiwan.

    依公務人員考試法第12條第1項前段規定,中華民國國民,年滿18歲,具有本法所定應考資格者,得應本法之考試。據此,報考公職應以具備中華民國國民身分為要件。
    According to the first paragraph of Article 12, Paragraph 1, of the Civil Service Examination Act, nationals of the Republic of China (Taiwan), over 18 years of age, holding required qualifications to sit examination under the Act may take the exam in accordance with the Act.     畢業生沒有辦法馬上升上二廚一職,是否能選擇做餐廳或飯店的外場人員? Graduates cannot be promoted to a second chef immediately. Can they choose to be a server at a hotel or restaurant?
    按外國人從事就業服務法第46條第1項第1款至第6款工作資格及審查標準(下稱審查標準)第10條規定略以,外國人受聘僱於觀光旅館業、旅館業,其工作內容應為經營及餐飲烹調技術為國內所缺乏者之工作。次按審查標準第4條第15款規定及勞動部(改制前行政院勞工委員會)94年6月21日勞職規字第0940503752號令及勞動部105年3月9日勞動發管字第10505020791號公告,其他經會商指定之工作項目為專業、科學或技術服務業之經營管理、設計、規劃或諮詢工作、餐飲業之廚師工作及公司法人設立之短期補習班廚藝教學工作。依前開規定,餐廳或飯店之外場人員非屬僑外生留臺工作範疇。
    Under Article 46, Item 1, paragraphs 1 to 6 of the Employment Service Act for Foreigners, the qualifications for work and the review standards (hereinafter referred to as the Review Standards) Article 10 are as follows, if foreigners are employed in the tourism industry or the hospitality industry, the job responsibility should be management, catering and cooking skills that are lacked in the country. Under the provisions of Article 4, paragraph 15 of the Review Standards, and the Ministry of Labor (formerly Executive Yuan Labor Committee) Order No. 0940503752 on June 21, 2005, and the Ministry of Labor on March 9, 2016, Labor Development Management No. 10505020791 announcement, other work items designated by consultation are operation management, design, planning or consulting work in professional, scientific or technical service industries, chef/cook in the food industry, and short-term culinary schools set up legally by companies or persons. According to the preceding regulations, servers in restaurants or hotels are not in the work category for overseas compatriots and foreign students in Taiwan.

    按外國人從事就業服務法第46條第1項第1款至第6款工作資格及審查標準(下稱審查標準)第4條第15款規定及勞動部(改制前行政院勞工委員會)94年6月21日勞職規字第0940503752號令及勞動部105年3月9日勞動發管字第10505020791號公告,其他經會商指定之工作項目包含餐飲業之廚師工作。次按審查標準第36條規定略以,上開雇主應符合資本額及營業額達一定金額以上之資格條件。故僑外生欲循評點制留臺於餐飲業工作,相關工作內容及雇主資格應符合前開規定。
    According to Qualifications and Criteria Standards for foreigners undertaking the jobs specified under Article 46.1.1 to 46.1.6 of the Employment Service Act (hereinafter referred to as the Review Standards) and the Ministry of Labor (formerly Executive Yuan Labor Committee) June 21, 2005, Labor Regulations Order No. 0940503752, and the Ministry of Labor's March 9, 2016, Labor Management No. 10505020791 announcement, other work items designated after consultation include chefs working in the food industry. Following the provisions of Article 36 of the Review Standard, the employer shall meet the qualification requirements for capital and revenue exceeding a certain amount.     美容美髮工作 Beauty and Hair (1)

    除了開放外國專業人士得申請在臺從事之工作項目之外的行業,若畢業後想延續其所學之專業繼續留在臺灣從事美容美髮工作,是否可以?或者需要什麼條件?
    1.外國人欲在臺工作,應符合「外國人從事就業服務法第46條第1項第1款至第6款工作資格及審查標準」(下稱審查標準)規定,經雇主申請從事(一)專門性或技術性工作(二)僑外資事業主管(三)學校教師(四)短期補習班專任教師(五)運動教練及運動員(六)藝術及演藝工作等6類工作。按審查標準規定,外國人如由雇主申請從事專門性或技術性工作,應具備大學畢業及2年相關工作經驗等資格,且受僱薪資達每月新臺幣4萬7,971元以上;其他工作類別則應具備各該專業資格。

    2.承上,美容美髮工作尚非上開專業工作範圍。惟僑外生在臺接受我國大學教育,可充實更多專業知識與技能訓練,在我國大學畢業後,得循僑外生留臺工作評點制申請留臺從事經營管理、研究、分析、設計、規劃、諮詢等專門性或技術性工作。

    留臺創業 Start a business in Taiwan (2)

    學生想要留台創業,是否有相關法令和規範? If overseas Chinese student and foreign student want to stay in Taiwan to start a business, are there any relevant laws and regulations?
    1.我國為延攬吸引國外創業家來臺創新創業,期更多國內外新創企業根植臺灣,活絡國內創業活動及經濟成長動能,政府已訂定「創業拔萃方案」,並開辦「創業家簽證」,如僑外生在臺畢業後欲自行創業,可申請該簽證,將提供來臺創業者1年之居留簽證,並可視創業實績申請延長居留,另勞動部鬆綁免除符合「創業拔萃方案」之新創僑外資事業聘僱外籍主管與新創事業聘僱外籍專門性及技術性人員之資本額或營業額限制。其申請程序、規定及資格條件,請逕洽經濟部(投資審議委員會)、外交部(領事事務局)、內政部(移民署)及勞動部(勞動力發展署)。
    1. In order to recruit and attract foreign entrepreneurs to Taiwan for innovation and entrepreneurship, more domestic and foreign start-ups are hoped to be rooted in Taiwan to activate domestic entrepreneurial activities and economic growth momentum. In light of this, the government has drawn up an “HeadStart Taiwan” and launched an “Entrepreneur Visa”. If overseas Chinese student and foreign student who want to start their own business after graduation in Taiwan may apply for this visa, which will provide a one-year resident visa for entrepreneurs who come to Taiwan, and apply for extension of residence based on the actual achievements of their businesses. Moreover, there is relaxation of and exemption from restrictions by the Ministry of Labor on the amount of capital or turnover of foreign or overseas Chinese new ventures that employ foreign supervisors and new ventures that employ foreign professionals and technical personnel that meet the “HeadStart Taiwan”. For application procedures, regulations and qualifications, please contact directly the Ministry of Economic Affairs (Investment Commission), the Ministry of Foreign Affairs (Bureau of Consular Affairs), the Ministry of the Interior (National Immigration Agency) and the Ministry of Labor (Workforce Development Agency).

    2.依勞動部「外國人從事就業服務法第46條第1項第1款至第6款工作資格及審查標準」第38條及第39條規定,略以外國人受聘僱於華僑或外國人經政府核准投資或設立事業擔任主管,聘僱第1人時,外國人免學經歷及薪資門檻限制;超過1人以上者,其外國人、雇主資格或其他資格,應符合聘僱專門性或技術性外國人相關規定;另雇主應具資本額50萬元以上或營業額300萬元以上或在臺設有辦事處具有工作實績。爰如僑外生在臺畢業後創立僑外資事業,並擔任其部門主管人員,即可依上開相關規定申請工作許可。
    According to Articles 38 and 39 of the “Qualifications and Criteria Standards for Foreigners Undertaking the Jobs Specified under Article 46.1.1 to 46.1.6 of the Employment Service Act” of the Ministry of Labor, which are summarized that for foreigners who are employed by overseas Chinese or foreigners to serve as supervisors in the undertaking they invested in or established with government approval, when the first person is employed, foreigners are exempt from restrictions on educational background and experience as well as salary threshold; When more than one person is employed, the foreigners, employer qualifications or other qualifications shall meet the relevant regulations on the employment of specialized or technical foreigners; In addition, employers shall have a capital of NTD500,000 or more, a turnover of NTD3 million or more, or have an office in Taiwan with actual work achievements. Therefore, if foreign or overseas Chinese students who found overseas Chinese businesses after graduation in Taiwan and serve as the department heads, they may apply for work permits in accordance with the relevant regulations.

    僑外生畢業後能否以自由工作者的身分或是自己開工作室的身分申請繼續留臺? Can overseas Chinese and foreign students apply to stay in Taiwan as a freelancer or be self-employed after graduation?
    一、 畢業僑外生留臺工作適用就業服務法第46條第1項第1款至第6款規定,即從事專門或技術性工作、僑外資事業主管工作、教師工作、運動、藝術及演藝工作;以及適用外國專業人才延攬及僱用法。外國專業人才延攬及僱用法為外國人在臺工作之特別法,主要規範內容包含核發給經中央目的事業主管機關審認具備外國特定專業人才資格者就業金卡,持就業金卡者無須受一定雇主聘僱及申請,可自行受僱從事就業服務法第46條第1項第1款至第6款規定之工作範圍;另新增開放外國人可自行申請從事自由藝術工作。
    二、 至畢業僑外生欲創業開立工作室以繼續留臺,其相關申請程序、規定及資格條件,建議洽詢經濟部(投資審議委員會)、外交部(領事事務局)、內政部(移民署)。
    1. The provisions of Article 46, Item1, paragraphs 1 through 6 of the Employment Services Act apply to overseas Chinese and foreign students working in Taiwan. i.e. to engage in specialized or technical work, work managing overseas Chinese funded businesses, teaching, sports, art, and performing arts work; and the Act for the Recruitment and Employment of Foreign Professionals also applies. Act for the Recruitment and Employment of Foreign Professionals is a specific law for foreigners working in Taiwan. The main contents of the regulations include the issuance of employment gold cards to those who have been approved by the central competent business authority as qualifying foreign professionals. Holders of employment gold cards do not need to be employed or be applied by certain employers. They can be self-employed and engage in the scope of work specified in Item 1, paragraphs 1 to 6 of Article 46 of the Employment Services Act; in addition, foreign professional can work as an artist.
    2. Overseas Chinese and foreign students who wish to start businesses or open workshops in Taiwan after graduation are advised to consult with the Ministry of Economic Affairs (Investment Commission), the Ministry of Foreign Affairs (Bureau of Consular Affairs), the Ministry of the Interior (Immigration Office) for relevant application procedures, regulations and eligibility conditions.
